Abstract
Notary Deeds and Land Deed Official Deeds are authentic deeds that should be the legal basis for the status of property, rights and obligations of a person if there is an error in making the deed, the rights and obligations of the person will be revoked. Notaries and PPATs as public officials who are authorized to make authentic deeds regarding legal acts so that Notaries and PPATs have an important role in ensuring legal certainty, order and legal protection, through authentic deeds made by and before them. Thus, authentic deeds are strong evidence and if a case or dispute occurs in Court, therefore the Notary and PPAT deeds provide perfect proof. This study aims to analyze theoretically and practically in a comprehensive manner the responsibility for the involvement of Notaries and PPATs in the forgery of signatures on power of attorney deeds which are the basis for making sales and purchase deeds based on the Decision of the Tangerang District Court Number 709/ PDT.G/2016/PN.Tng. Through a normative legal approach, this study analyzes relevant laws and regulations. The results of the study indicate that unlawful acts committed by Notary/PPAT officials can be subject to administrative sanctions in the form of revocation of permits or disrespectful sanctions from professional organizations. Second, civil sanctions in the form of an obligation to pay compensation to the injured party. Third, criminal sanctions in the form of imprisonment based on the provisions of the Criminal Code (KUHP). The criminal sanctions that can be imposed on Notaries or PPATs who are proven to have falsified authentic deeds are quite severe.
