Abstract

This research was motivated by the emergence of a Minister of Home Affairs regulation which regulates the issuance of birth certificates for children resulting from unregistered marriages without attaching marriage documents in the form of marriage certificates or extracts of marriage certificates from both of the child's parents. The aim of this research is to determine the legal position of children from unregistered marriages who have birth certificates with the names of both parents and the child's right to receive inheritance rights from their father. The research method used is normative juridical using literature study. The data sources used are secondary, containing primary, secondary and tertiary legal materials. The data analysis used is normative qualitative, namely the discussion and explanation of research data based on legal norms or rules and doctrines that are related to the problems raised by the researcher. The results of this research show that the legal status of children from unregistered marriages who have birth certificates with the names of both parents listed are recognized by the State as legitimate children of both parents. The child's right to receive inheritance rights from his father can be seen that children cannot obtain inheritance rights from their father because the child's existence is not formally recognized as a legitimate child because the status of both of the child's parents is not legally valid in the state or not officially registered at the Office of Religious Affairs (KUA).
