Abstract

The increasing number of suspects in drug abuse cases will lead to a rise in the number of prisoners. Unfortunately, the sentences handed down often do not match the capacity of the correctional institutions, resulting in overcrowding. In reality, sentencing no longer creates a deterrent effect for the perpetrators, necessitating a reform in criminal law, where it is time for the sentencing system to shift its approach from retributive to Restorative Justice. The purpose of this research is to understand the concept of implementing Restorative Justice guided by the Attorney General’s guidelines of the Republic of Indonesia Number 18 of 2021. This study uses a Juridical-empirical research method and a qualitative descriptive approach. Data collection methods were carried out with field studies and literature studies. This research was conducted at the Surabaya State Prosecutor’s Office. The results of this study state that the concept of applying the guidelines of the attorney general of the Republic of Indonesia no. 18 of 2021 is motivated by two things: the current law enforcement policy in the criminal justice system tends to be punitive (application of punishment) and the Policy of Optimizing rehabilitation institutions is characterized by Victimless Crime. The implementation at the Surabaya State Prosecutor’s Office is carried out in two stages: the Pre-Prosecution Stage and the Prosecution Stage.
