Abstract

Even though Indonesia adheres to a civil law system, the idea of Amicus Curiae, which means "friend of the court," is starting to be used there. The idea comes from the common law system. The idea behind this is for impartial parties to provide their legal views to the court without being personally involved in the case. Amicus Curiae has been used in several cases to provide judges with different points of view and strengthen their legal considerations, but this has not been clearly regulated in Indonesian law. This research analyzes all statutory regulations in Indonesia in connection with the incorporation of a statutory approach to normative legal research into the Amicus Curiae process in the country's justice system. Despite existing challenges, such as ambiguous laws and the potential for abuse of this position, research shows that the employment of Amicus Curiae has grown since 2008. From a human rights perspective, Amicus Curiae can be seen as a means of enforcing International protection. Covenant on Civil and Political Rights, which includes freedom of opinion, expression and security before judicial authorities. If the Indonesian criminal justice system can implement more explicit and specific Amicus Curiae regulatory recommendations, the system will become more open, accountable and fair.
