Abstract
Government Regulation Number 35 of 2020 concerning Providing Compensation, Restitution and Assistance to Witnesses and Victims and Supreme Court Regulation Number 1 of 2022 concerning Procedures for Settlement of Applications and providing Restitution and Compensation To Victims of Crime govern the process by which victims of the crime of money laundering by the Evotrade Trading robot can fulfil their right to restitution. In their ruling, the Appeals Panel of Judges acknowledged that victims of the evotrade trading robot money laundering crime have a right to restitution. The panel determined that all confiscated assets should be returned to the victims through legal representatives in a proportional manner, and any additional assets should be confiscated to the state. According to the regulations in force in Indonesia, this research seeks to fulfil the right of reparation for victims of the evotrade trading robot money laundering crime. The normative juridical approach is used in this study, which means that original legal materials like theories, concepts, principles, and statutes—both primary and secondary—were consulted. Data analysis employs a method known as descriptive analytics. Findings from this study support the idea that all crime victims should be entitled to financial compensation or restitution, as outlined in Supreme Court Regulation No. 1 of 2022 and Government Regulation No. 35 of 2020, respectively, which govern the processes for settling applications and providing such benefits to crime victims. Victims of crimes in Malang District Court did not get their rightful compensation for losses sustained as a result of the ruling in case number 328/Pid.Sus/2022/PN.Mlg, which had originally stated that the perpetrator would get all confiscated assets while the state would get some.
