Indonesia is a legal country which of course also has a legal entity with the aim of providing justice and comfort for all people in Indonesia. The Constitutional Court is one of the executors of judicial power. The Constitutional Court has duties and authorities as regulated in Law no. 8 of 2011 concerning Amendments to Law no. 24 of 2003 concerning the Constitutional Court. In carrying out its duties, the Constitutional Court can certainly make mistakes, therefore a code of ethics for constitutional judges has emerged which is regulated in Constitutional Court Regulation No. 9 of 2006 concerning the code of ethics for constitutional judges or known as Sapta Karsa Hutama. Decisions issued by constitutional judges are final and binding on the entire community, not just the parties to the dispute. MK in MK Decision No. 90 of 2023 explains the judge's error in decision making, this is in line with the issuance of MKMK decision no. 1 of 2023 which explains that there was an error in making the decision. The existence of a judge's decision that made an error in the decision-making process should cause the decision to be invalid. In fact, currently the decision remains in effect due to the absence of further regulations on this issue or an institution authorized to revoke the Constitutional Court's decision. This research aims to determine the existence of decisions issued by constitutional judges if in the trial process they violate the code of ethics. Use of normative juridical research methods with conceptual, statutory and case approaches.
