Abstract

Companies have a responsibility to offer assurances to workers in order to prevent them from feeling disadvantaged when it comes to addressing labor rights disputes related to work accident compensation. Workplace accidents are the predominant occurrences in comparison to other forms of accidents. These incidents have immediate and observable impacts, and they are duly documented and reported. The objective of this study is to identify the constraints associated with work accidents and ascertain the entitlement to compensation for work accidents at PT. X Sidoarjo. This study use empirical juridical procedures, which involve performing field research. Data sources were acquired from books, legal journals, and relevant legislation. Data analysis employs a sociological and legalistic methodology. According to legislative laws, all employers, save state administrators, are required to enroll themselves and their employees in the Work Accident Insurance (JKK) and Death Benefit programs with BPJS Employment. Companies must gradually enroll all their employees as participants in BPJS and integrate them in the workforce social security program. Nevertheless, there are still corporations who demonstrate negligence in fulfilling their obligation to provide guarantees to their employees.
