Abstract

Franchising is regulated in Article 1 of Government Regulation Number 42 of 2007 explaining that a franchise is a special right owned by an individual or business entity to a business system with business characteristics in order to market goods and/or services that have been proven successful and can be utilized and/or used by parties. other. A franchise agreement is a form of legal protection from parties who commit prohibited acts or harm one of the parties. This research will discuss unwritten franchise agreements. The method used in this research is normative juridical which is based on statutory regulations, legal theory and expert opinions. The author collected primary and secondary data which was then analyzed qualitatively, namely linking descriptive data to a particular issue which was linked to literature and opinions of legal experts and based on applicable laws and regulations. The results of this research explain whether or not the legal conditions in the franchise agreement have been fulfilled as well as the legal consequences of an unwritten franchise agreement as stated in Decision Number 396/PDT/2021/PT.DKI. From this analysis, it was concluded that an unwritten franchise agreement is not in accordance with Article 4 paragraph 1 of Government Regulation Number 42 of 2007 concerning Franchising which requires that franchise agreements be executed in writing in accordance with applicable regulations.
