Abstract

The employment problem in Indonesia is a complex problem, referring to cases of termination of employment due to bankruptcy causing workers or laborers to be terminated and workers' rights not paid. This causes industrial relations disputes between workers and companies. The aim of this research is to determine the procedures for terminating employment relations and forms of legal protection for workers due to bankruptcy in terms of Law Number 6 of 2023 concerning Job Creation. This research uses normative juridical research. Data collection was done through literature study and interviews with sources. Data analysis was carried out through 4 (four) stages, namely data checking, data editing, data systematization, descriptive analysis. The approach in this research is a qualitative approach. The results of the research explain that termination of employment has an impact on workers from various aspects and the obstacles that occur in the field make it difficult to resolve the payment of workers' rights due to company bankruptcy. As well as legal protection that has not been implemented optimally in providing legal certainty for workers who experience losses. Apart from that, there is also a need for additional regulations governing the time limit for payment of workers' rights due to bankruptcy as well as increased supervision in the implementation of the settlement of payments for workers' rights in bankruptcy by the relevant institutions.
