This research analyses the authority of institutions issuing Surat Keterangan Waris (SKW) before the abolition of the population classification rules and afterwards. The research conducted here uses doctrinal legal research methods. The result of the research is that before the abolition of population classification in Indonesia, people made SKW in accordance with their respective population groups based on Article 111 paragraph (1) letter c of PMNA 3/1997. After the abolition of population classification by the Population Administration Law and the issuance of Permen ATR / BPN 16/2021, there is a unification of institutions authorized to issue SKW. As a result, people are now free to choose any institution to process the SKW. The abolition of population classification shows the need to establish a National Inheritance Law that is not based on population classification, but in accordance with the spirit of the Indonesian Nation, namely Pancasila.
