Abstract
Life in prison is inseparable from restrictions that regulate obligations and prohibitions. In accordance with Article 11 of Law Number 22 of 2022 concerning Corrections, every prisoner is obliged to comply with the rules and regulations, follow the training program in an orderly manner, maintain a clean, safe, orderly and peaceful life and respect the human rights of everyone in his environment. Disciplinary punishment for prisoners according to Minister of Law and Human Rights Regulation Number 6 of 2013 is divided into 3 types, namely light level disciplinary punishment, medium level disciplinary punishment, and heavy level disciplinary punishment. The application of disciplinary punishment is very necessary, especially for prisoners who commit serious disciplinary violations. The purpose of this research is to determine the implementation of revocation of rights for prisoners who commit serious violations of disciplinary regulations and the obstacles to its implementation. The type of research method used is empirical juridical. Data collection methods use interview techniques, observation and literature study. The analytical method used is qualitative data analysis. The results of the research are that the implementation of the revocation of prisoners' rights in the Sidoarjo Class IIA Prison has been appropriate, but there are still several prisoners who have not been sentenced to severe disciplinary sentences in the form of revocation of their rights due to several forgiving reasons. Apart from that, there are several obstacles such as a lack of socialization regarding the rules and regulations of correctional institutions, the long process of submitting administrative documents, and the limited number of solitary confinement cells. However, these obstacles can be overcome with several efforts.
