Abstract

This article explore the current landscape of influencer marketing, its impact on consumer protection, and the need for tailored legal instruments to enhance transparency and accountability in this domain. The evolution of marketing practices, driven by technological advancements, has introduced significant shifts in consumer habits related to product promotion and purchase decisions. This article aims to analyze the urgency of Influencers' knowledge on the provisions of the Consumer Protection Law and Indonesian Advertising Ethics before over-promoting some products to consumers and to determine the legal regulation for Influencers who provide information that can harm consumers according to the Consumer Protection Law. This study uses normative legal research methodology with secondary data taken from the library and previous-related journals. The result of this study shows that there is no specific regulation that can ensnare Influencers if they are proven to provide untrue, unfavorable, and dishonest information. Because there is no statement stating that Influencers are included and can be categorized as advertising business actors in promoting a product. This is because Influencers are a new element in promoting products following the times. Consumer protection law must also have all efforts to ensure legal certainty for consumers and provide protection to consumers. This includes consumer rights that must be respected and become a reference for business actors in offering their products in the future. Therefore, legal certainty is needed to regulate the responsibility of Influencers in consumer protection.
