Abstract
Exhibitionism is a sexual disorder that is currently popular in society, where someone commits an act by showing off his genitals to other people or in public. Indonesia has not regulated in detail the rules regarding acts of exhibitionism, this causes judges to not be fully effective in deciding cases, as is the case with the controversy over the differences in Decision Number 26/Pid.Sus/2021/PN.Kph and 23/Pid.B/2022/ PN. WAT. This research discusses criminal regulations and the application of law to perpetrators of exhibitionism in Indonesia. Juridical-normative method with a comparative approach, statutory approach and case approach. The results of the research show that judges in deciding cases use legal considerations looking for relevant laws, the perpetrators of exhibitionism have not received a fair sentence, because of the need for rehabilitation of the perpetrators, supported by the absence of governing regulations. The judge only gave suggestions for the perpetrator to be rehabilitated but took no further action. Legal and government officials must make regulations regarding exhibitionism to minimize problems that will arise in the future.
